1. Acceptance of Terms
Welcome to FunLand Kids Park. By accessing and using our facilities, services, and website, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services. The materials contained in our facilities and on this website are protected by applicable copyright and trademark law.
These terms apply to all visitors, users, and others who access or use our services, including parents, guardians, children, and any accompanying adults. We reserve the right to modify these terms at any time without prior notice, and your continued use of our services constitutes acceptance of any such modifications.
2. Facility Usage and Safety Requirements
All children must be accompanied by a responsible adult (18 years or older) at all times while on our premises. Parents and guardians are solely responsible for the supervision and safety of their children throughout their visit. We maintain the highest safety standards, but ultimate responsibility for child welfare remains with the accompanying adult.
Age and height restrictions apply to certain attractions and activities. These restrictions are clearly posted and must be strictly observed for safety reasons. We reserve the right to deny access to any attraction if safety requirements are not met. All participants must follow posted safety guidelines and staff instructions at all times.
Proper attire is required for all activities. Closed-toe shoes are mandatory for most attractions. We recommend comfortable clothing suitable for active play. Items such as jewelry, loose clothing, or accessories that may pose safety hazards may need to be removed before participation in certain activities.
3. Admission and Pricing
Admission fees are subject to change without notice and are non-refundable except in circumstances beyond our control that result in facility closure. All prices are listed in Canadian dollars and include applicable taxes where required by law. Payment must be made in full prior to facility access.
Group discounts, birthday party packages, and special promotions are subject to availability and specific terms and conditions. Advance booking is required for group events and birthday parties. Cancellation policies for special events and parties are provided at the time of booking.
Season passes and membership programs have separate terms and conditions that are provided upon purchase. These programs offer specific benefits and are subject to their own renewal, cancellation, and usage policies.
4. Code of Conduct
All visitors must conduct themselves in a manner that ensures the safety and enjoyment of all guests. Aggressive behavior, inappropriate language, or any actions that may endanger others are strictly prohibited and will result in immediate removal from the premises without refund.
Running in non-designated areas, climbing on equipment not designed for climbing, or misuse of facilities is prohibited. Food and drinks must be consumed only in designated dining areas. Outside food and beverages are not permitted unless required for medical reasons or dietary restrictions (with prior approval).
Photography and video recording for personal use are permitted, but commercial photography or recording requires written permission. Visitors must respect the privacy of other guests and staff when taking photos or videos.
5. Limitation of Liability
FunLand Kids Park, its owners, operators, employees, and affiliates shall not be liable for any injuries, accidents, lost or stolen items, or damages of any kind that occur on the premises or result from participation in our activities. By entering our facility, you assume all risks associated with your visit.
We maintain comprehensive insurance coverage and follow strict safety protocols, but participation in physical activities always carries inherent risks. Parents and guardians acknowledge these risks and agree that participation is voluntary and at their own risk.
Our liability is limited to the amount paid for admission on the day of the incident. This limitation applies regardless of the cause of action, whether based on contract, tort, negligence, strict liability, or otherwise.
6. Medical Conditions and Health Considerations
Visitors with medical conditions, physical limitations, or special needs must inform our staff prior to participation in any activities. We strive to accommodate all guests but reserve the right to exclude individuals from specific activities if participation would pose a safety risk to themselves or others.
Parents must disclose any relevant medical conditions, allergies, or medications that might affect their child's ability to safely participate in activities. Our staff are trained in basic first aid, but we recommend that parents of children with serious medical conditions remain in close proximity during activities.
In case of medical emergencies, we will provide immediate first aid and contact emergency services if necessary. Parents are responsible for any medical costs associated with treatment of injuries or medical episodes occurring on our premises.
7. Privacy and Data Protection
We respect your privacy and are committed to protecting your personal information. Our Privacy Policy, which is incorporated into these Terms of Service, explains how we collect, use, and protect your information when you visit our facility or use our services.
By using our services, you consent to the collection and use of information as outlined in our Privacy Policy. We may use information for operational purposes, marketing communications (with your consent), and to improve our services.
Photos and videos taken by our staff during events or activities may be used for marketing and promotional purposes unless you specifically opt out. Please inform our staff if you do not wish to have photos taken or used for promotional purposes.
8. Intellectual Property
All content on our website, including but not limited to text, graphics, logos, images, audio clips, video clips, and software, is the property of FunLand Kids Park or its content suppliers and is protected by Canadian and international copyright laws.
The FunLand Kids Park name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of FunLand Kids Park or its affiliates. You may not use such marks without our prior written permission.
Any unauthorized use of our intellectual property may violate copyright, trademark, and other applicable laws and could result in criminal or civil penalties.
9. Force Majeure and Facility Closure
FunLand Kids Park reserves the right to close the facility temporarily or permanently due to circumstances beyond our control, including but not limited to severe weather, natural disasters, public health emergencies, government orders, or facility maintenance requirements.
In case of unexpected closure, we will provide reasonable notice when possible and work with guests to reschedule visits or provide appropriate compensation. However, we are not liable for any indirect costs or damages resulting from facility closures due to force majeure events.
Scheduled maintenance closures will be announced in advance through our website and social media channels. We appreciate your understanding and cooperation during these necessary maintenance periods.
10. Dispute Resolution and Governing Law
These Terms of Service and any disputes arising from or relating to your use of our services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
Any legal disputes will be resolved through the courts of Ontario, Canada. Both parties consent to the jurisdiction and venue of such courts. Before pursuing legal action, we encourage all parties to attempt resolution through direct communication with our management team.
If any provision of these Terms of Service is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect. These terms constitute the entire agreement between you and FunLand Kids Park regarding the use of our services.
